General Terms and Conditions (Terms of Service)

1. Scope and Seller
These General Terms and Conditions apply to purchases made through the online shop operated under MyDogon at www.mydogon.com.

MyDogon is operated as a sole proprietorship and is not registered in the German Commercial Register.
These Terms apply primarily to contracts with consumers. A consumer is a natural person who enters into a transaction predominantly for purposes that cannot be attributed to their commercial or independent professional activity.
Mandatory statutory consumer rights remain unaffected by these Terms.
2. Products
MyDogon sells primarily modern decorative objects from West Africa, including handmade or artisan-made brass statuettes.
Unless expressly stated otherwise in the individual product description, the products offered by MyDogon are modern decorative objects and are not antiques or archaeological objects.
Because many products are handmade or artisan-made, minor irregularities and variations in surface, colour, patina, dimensions, weight, shape or finish may occur.
Such characteristics are part of the handmade nature of the products and do not constitute a defect insofar as they are customary for this type of product, are apparent from the product description or photographs, or have otherwise been disclosed before purchase.
Where an individual item is photographed and offered as a unique or individually identified piece, the photographs relate to that particular item.
Where a product is offered as part of a handmade series, minor differences between the item shown and the item delivered may occur, provided that the agreed characteristics and overall nature of the product are maintained.
The specific description, dimensions, materials, photographs and other characteristics stated on the respective product page form part of the product description.
Product images may appear slightly different depending on screen settings and lighting. This does not affect the customer's statutory rights where the goods do not conform to the agreed characteristics.
Products sold as decorative objects are not intended to be used as toys unless expressly stated otherwise.
3. Ordering Process and Conclusion of Contract
The presentation of products in the online shop does not itself constitute a legally binding offer to conclude a purchase contract.
By placing an order using the checkout and clicking the final button indicating an obligation to pay, the customer submits a binding offer to purchase the products contained in the shopping cart.
Before submitting the order, the customer can review and correct the information entered using the functions provided in the shopping cart and checkout.
After the order has been submitted, the customer will receive an electronic confirmation that the order has been received.
A purely automated confirmation of receipt does not constitute acceptance of the order unless it expressly states that the order has been accepted.
We may accept the customer's offer within three business days by:

expressly confirming acceptance of the order by email; or

sending a shipping or dispatch confirmation.
If we do not accept the order within this period, the offer is deemed rejected. Any payment already collected will then be refunded without undue delay.
The contract language is English, unless another language is expressly offered during the ordering process.
Order information is stored by us in accordance with statutory requirements. The customer receives relevant order information electronically. These Terms can also be downloaded, saved or printed before completing an order.
4. Availability
Products are offered subject to availability.
Many MyDogon products are available only in small quantities or as individual pieces.
If a product is unexpectedly unavailable before a contract has been concluded, we may decline the order and will inform the customer without undue delay.
If performance becomes impossible after a contract has already been concluded, the statutory provisions apply. Any payment received for goods that cannot be supplied will be refunded without undue delay where legally required.
5. Prices and Payment
All prices displayed in the online shop are final prices in the currency displayed at checkout.
MyDogon currently applies the German small business scheme pursuant to § 19 UStG (German VAT Act). Therefore, German VAT is not charged and is not separately shown.
Shipping or delivery costs may be charged in addition to the product price. Where applicable, these costs are displayed before the customer submits the binding order.
The available payment methods are displayed during the checkout process.
Payment processing may be carried out by third-party payment providers, including payment providers integrated through Shopify. Their additional terms may apply to the processing of the payment.
6. Shipping and Delivery
The countries and regions to which MyDogon currently delivers are displayed in the online shop and/or during checkout.
Available delivery methods, shipping costs and estimated delivery times are shown during the ordering process.
Delivery times stated in the online shop are estimates unless a binding delivery date has expressly been agreed.
We will process and dispatch orders within the delivery periods stated for the relevant product or shipping method.
Events outside our reasonable control, such as customs delays, strikes, natural events, transport disruptions or comparable circumstances, may affect delivery times. We will inform customers of significant delays where reasonably possible.
This does not restrict any statutory rights the customer may have because of delayed delivery.
7. Transfer of Risk
For consumers, the risk of accidental loss or accidental deterioration of the goods generally passes to the customer only when the goods are delivered to the customer or to a third party designated by the customer who is not the carrier.
The mere handover of the goods by MyDogon to DHL, another parcel service, a freight forwarder or another carrier does not transfer the transport risk to a consumer.
Different statutory rules may apply if the customer independently commissions a carrier that was not previously offered or designated by us.
For customers who purchase as entrepreneurs, the statutory rules applicable to commercial shipment apply.
8. Retention of Title
The goods remain our property until the purchase price has been paid in full.
9. Right of Withdrawal
Consumers may have a statutory right of withdrawal for distance contracts.

and in the statutory model withdrawal form provided there.
Nothing in these Terms restricts a statutory right of withdrawal.
Where legally required, an electronic withdrawal function is also made available through the online shop.
10. Defective, Damaged or Non-Conforming Goods
The statutory rights relating to defective or non-conforming goods apply.
If goods arrive damaged, are defective, or are different from what was ordered, customers should contact us at:
Where useful, customers may send photographs and their order number to help us assess and resolve the issue quickly.
Failure to provide photographs or to contact us immediately does not remove statutory consumer rights.
The statutory rights for defective goods are separate from the 14-day statutory right of withdrawal.
Nothing in these Terms excludes or restricts statutory warranty or conformity rights that cannot legally be excluded or restricted.
11. Handmade Characteristics
The handmade or artisan-made character of a product may result in minor differences between individual items.
A characteristic is not treated as a defect merely because it reflects normal handmade production, provided that the product still conforms to the description and the characteristics agreed when the contract was concluded.
Any material departure from the agreed description remains subject to the customer's statutory rights.
12. International Deliveries and Customs
For deliveries to destinations outside the European Union, customs duties, import taxes or other charges may be imposed by the destination country.
Unless expressly stated otherwise during checkout, such charges are not included in the purchase price or shipping price and may be payable by the recipient to the competent customs authority or another authority.
Customers ordering delivery outside the European Union are responsible for complying with applicable import requirements in the destination country.
MyDogon will provide commercially reasonable documentation required for the shipment.
Nothing in this section affects mandatory consumer rights.
13. Liability
We have unlimited liability for:

intentional conduct and gross negligence;

damage resulting from injury to life, body or health caused by negligent or intentional breach of duty;

claims under mandatory product liability law; and
-
liability that cannot otherwise legally be excluded or limited.
In cases of ordinary negligence involving the breach of an essential contractual obligation, our liability is limited to damage that was foreseeable and typical for this type of contract.
An essential contractual obligation is an obligation whose fulfilment makes proper performance of the contract possible in the first place and on whose fulfilment the customer may normally rely.
Except in the cases described above, liability for ordinary negligence is excluded to the extent permitted by law.
The above limitations also apply in favour of our legal representatives and agents where claims are asserted directly against them.
Mandatory statutory consumer rights remain unaffected.
14. Intellectual Property
The content of the MyDogon website, including photographs, texts, graphics, logos and designs, may be protected by copyright, trademark law or other intellectual property rights.
Where such rights belong to MyDogon or its licensors, the content may not be reproduced, distributed, commercially exploited or otherwise used beyond what is permitted by law without prior consent.
This clause does not claim intellectual property rights over cultural traditions, historical designs, artistic traditions or other subject matter in which MyDogon does not hold such rights.
Product images and website content may be used for personal purposes only unless applicable law permits further use.
15. Shopify and Other Service Providers
The MyDogon online shop is technically hosted and supported by Shopify.
Shopify provides technical infrastructure and related services but is not the seller of the products offered by MyDogon.
Purchase contracts for MyDogon products are concluded between the customer and MyDogon.
We may also use third-party providers for payment processing, shipping, analytics, email communication and other functions required to operate the online shop.

16. Data Protection
Personal data is processed in accordance with applicable data-protection law and our separate Privacy Policy.
The Privacy Policy explains, among other things, how personal data may be processed by us, Shopify, payment providers, shipping providers and other service providers used to operate the online shop.
17. Prohibited Use
The website may not be used for unlawful purposes or in a manner that infringes the rights of MyDogon or third parties.
In particular, users may not intentionally interfere with the security or technical operation of the online shop, introduce malicious software, misuse personal information, or use the website to commit fraud or another unlawful act.
This provision does not restrict lawful access, statutory rights, ordinary use of search engines, or rights granted under applicable law.
18. Applicable Law
The laws of the Federal Republic of Germany apply to contracts concluded with MyDogon.
For consumers, this choice of law does not deprive them of the protection afforded by mandatory provisions of the law of the country in which they have their habitual residence where such protection applies under applicable European or international law.
19. Jurisdiction
The statutory rules concerning jurisdiction apply.
Nothing in these Terms restricts a consumer's right to bring proceedings before a court that has jurisdiction under mandatory national or European consumer-protection rules.
20. Changes to These Terms
The version of these Terms applicable at the time an order is placed forms part of the relevant contract.
We may amend these Terms for future orders where necessary.
Changes published after a contract has already been concluded do not retroactively change that contract unless the parties expressly agree otherwise or applicable law provides otherwise.
21. Severability
If an individual provision of these Terms is invalid or unenforceable, the remaining provisions remain unaffected to the extent permitted by law.
The relevant statutory provisions apply in place of any invalid provision.
